Terms and Conditions

Please read these Terms and Conditions carefully before using the BlogManager.app platform (“Service”).

1. Interpretation and Definitions

Interpretation

Words with capitalized initials have meanings defined under the following conditions. These definitions apply whether the terms appear in singular or plural.

Definitions

Affiliate:
An entity that controls, is controlled by, or is under common control with a party. “Control” means ownership of at least 50% of voting securities or equivalent authority.

Country:
Refers to Gujarat, India.

Company:
“BlogManager.app”, operated by The Clueless Company, located at:
2/1498, Popat Street, Beside Hanuman Temple, Sagrampura, Surat – 395002, Gujarat, India.
Referred to as “the Company”, “We”, “Us”, or “Our” in this Agreement.

Device:
Any device capable of accessing the Service such as a laptop, desktop, phone, or tablet.

Service:
Refers to the SaaS platform, tools, and features provided through BlogManager.app and our website.

Terms and Conditions (“Terms”):
These Terms form the complete agreement between you and the Company regarding the use of the Service.

Third-party Services:
Any content, tools, software, data, or services provided by third parties that may be integrated into or accessible through BlogManager.app.

Website:
Refers to https://www.blogmanager.app.

You:
The individual or the company/legal entity using or accessing the Service.

2. Acknowledgment

These Terms regulate your use of the BlogManager.app Service and constitute a binding agreement between you and the Company.

By accessing or using the Service, you acknowledge that:

  • You have read and understood these Terms
  • You agree to be legally bound by them
  • You are at least 18 years of age

If you do not accept these Terms, you must stop using the Service immediately.

Your use of the Service is also governed by our Privacy Policy, which explains how we collect and protect your data.

3. Links to Other Websites

Our Service may include links to third-party websites or services.
We have no control over these third-party sites and assume no responsibility for their content, policies, or practices.

We strongly recommend reviewing the Terms and Privacy Policies of any third-party site you visit.

4. Termination

We may suspend or terminate your access to the Service immediately and without notice if you breach these Terms or engage in harmful, abusive, or illegal activity.

Upon termination:

  • Your right to use the Service stops immediately
  • Any stored data may be deleted permanently as per our data retention policy

5. Limitation of Liability

To the maximum extent permitted by law:

  • The Company’s total liability for any claim shall not exceed the amount you paid for the Service, or USD 100 if no payment was made.
  • We are not liable for indirect, incidental, special, or consequential damages, including but not limited to:
    • Loss of revenue or profit
    • Loss of data
    • Business interruption
    • Personal injury
    • Loss of privacy
    • Third-party misuse, system failures, or cyber-attacks

Some jurisdictions do not permit certain exclusions, so these limitations may apply only to the extent permitted by law.

6. “AS IS” & “AS AVAILABLE” Disclaimer

The Service is provided on an “AS IS”, “AS AVAILABLE” basis without warranties of any kind.

We do not guarantee that:

  • The Service will be uninterrupted or free from errors
  • The Service will be compatible with all devices or software
  • Data integrity or availability will be continuous
  • The Service will meet your specific performance expectations
  • Errors or defects will always be corrected promptly

We also do not warrant that our platform, servers, emails, or content are free from malware, viruses, harmful code, or vulnerabilities.

7. Governing Law

These Terms are governed by the laws of Gujarat, India, without regard to conflict of law principles.

Your use of BlogManager.app may be subject to additional local, national, or international regulations depending on your country.

8. Dispute Resolution

Before taking legal action, you agree to attempt to resolve any dispute informally by contacting us at support@blogmanager.app.

9. For European Union (EU) Users

If you are an EU resident, you are entitled to the mandatory rights and protections under the laws of your country of residence.

10. United States Legal Compliance

You confirm that:

  • You are not located in a country under a U.S. embargo or designated as supporting terrorism
  • You are not on any U.S. government list of restricted or prohibited parties

11. Severability & Waiver

Severability

If any provision of these Terms is found invalid, the remaining provisions will continue in full force with necessary modifications to maintain their original intent.

Waiver

Failure to exercise any right or enforce any obligation does not constitute a waiver of that right or obligation.

12. Translation

If these Terms are translated into other languages, the English version prevails in case of disagreement.

13. Changes to These Terms

We reserve the right to update or modify these Terms at any time.
If changes are material, we will provide at least 30 days’ notice before the new terms apply.

Continued use of the Service means you accept the updated Terms.

If you do not agree to the changes, you must stop using BlogManager.app.
